SNS Terms of Use

MIRAIT ONE Corporation (the “company”) sets forth the following Terms of Use (the “Terms”) with respect to the operation and use of the company’s official social media accounts (the “Official Accounts”). Users (as defined in Article 4) are requested to read these Terms before using the Official Accounts.

Article 1 (Purpose of Use and Applicable Accounts)

The company will operate the following Official Accounts for the purpose of transmitting information from the company to Users.

Article 2 (Scope of Application of and Amendment to These Terms)

* These Terms apply to the company and Users in relation to the operation and use of the Official Accounts.
* The company may amend these Terms without the prior consent of Users. The amended Terms will automatically take effect at the time of their publication via posting on the company’s website, etc., and thereafter the Users will be subject to the amended Terms.

Article 3 (Operation and Use of the Official Accounts)

*The company may change the content of the Official Accounts or terminate the operation of the Official Accounts without prior notice to Users. Further, the company does not guarantee that the company will update the Official Accounts.
*Posts and comments made on the Official Accounts will be regarded as public information and may be stored or recorded by the company.
*Users shall use the Official Accounts in accordance with these Terms.

Article 4 (Use and Users)

*“Use” refers to browsing the Official Accounts, or taking any action such as making posts or comments, or hitting the like button. Persons who use the Official Accounts are referred to as “Users.”
*If Users use the Official Accounts, they will be regarded as having agreed to these Terms.

Article 5 (Access to Basic Information)

The company may access information made public by the User, such as the name or profile picture of the User, in accordance with the User’s social media settings.

Article 6 (Disclaimers)

*The information on the Official Accounts is current as of the time of transmission. Further, the information transmitted by the company via its Official Accounts does not necessarily represent the company’s official announcements or views. For the company’s official announcements and views, please refer to the company’s news releases, etc.
*The company is under no obligation to guarantee the accuracy or completeness of the information on the Official Accounts. The company assumes no responsibility for any damage or trouble caused to Users in relation to the information transmitted by the company on the Official Accounts, various kinds of provided information published by third parties, or any changes or updates to the display, etc. of various kinds of provided information.
*The company will not be liable under any circumstances for any damage, loss or disadvantage caused to Users in connection with the use of the Official Accounts, regardless of the legal cause of action.
*Any and all information published through posting or commenting on the Official Accounts by third parties is the sole responsibility of such third parties who made the relevant post/comment, and the company does not assume any responsibility therefor. Further, any information published by third parties is not endorsed by the company and does not represent the company’s views.
*As the Official Accounts are operated via the systems of each social media provider, the company makes no warranty regarding their functionality or safety. The company will not answer any questions regarding the system operation status of external companies or the functions, usage methods, and technical aspects of the software or applications provided by outside companies, etc.
*The company does not respond to all User comments and inquiries received via the Official Accounts.
*Please note that the company does not accept sales activities, consultation, or inquiries about the activities of the company, etc. via the Official Accounts.
*Depending on the browsing environment, such as the type of browser of the User, browsing may be hindered, such as not being able to load the Official Accounts properly. The company will not be liable for any damage caused to Users by not being able to use the Official Accounts.

Article 7 (Prohibited Acts)

*Acts such as (1) to (22) below are prohibited on the Official Accounts. Please note that the company may delete posts and comments, block accounts, and take other necessary measures without reporting or notifying you if any of the following applies. If the company incurs any damage due to the User’s acts, the company may claim compensation for such damage from such User.
*If the User causes any damage to a third party by using the Official Accounts, such User must resolve the matter at his/her own responsibility and expense.

(1) Acts that infringe or are likely to infringe interests;
(2) Infringing the rights of third parties (intellectual property rights such as copyrights and trademark rights, privacy, etc.);
(3) Infringing the rights of third parties through defamation or the use of discriminatory expressions;
(4) Disclosing, identifying, or leaking the personal information of oneself or others;
(5) Violating laws, regulations or ordinances;
(6) Promoting, suggesting or encouraging violence or unlawful acts, etc.;
(7) Transmitting any obscene content or any content that the company deems inappropriate;
(8) Engaging in or inducing a crime;
(9) Impersonating a third party, including the company;
(10) Engaging in promotion or solicitation for political, electoral, religious or other groups or organizations;
(11) Conducting sales activities by utilizing the company’s service or providing information for profit-making purposes;
(12) Soliciting investment, donations, provision of funds or purchase of goods or services, etc.;
(13) Spamming;
(14) Unauthorized uploading of rights-protected software or files;
(15) Uploading harmful files or programs such as computer viruses;
(16) Engaging in acts of unauthorized access such as hacking, as well as conducting monitoring or copying;
(17) Engaging in frame-linking or other forms of linking that impair the clarity of the Official Accounts;
(18) Acts that cause or may cause it to be misunderstood, without any factual basis, that there is some kind of affiliation or cooperative relationship with the company, or that the company or a third party recognizes, warrants, endorses or recommends a linked site;
(19) Preventing use or access by other users;
(20) Interfering with the company’s operation of the Official Accounts;
(21) Making posts that are irrelevant to the purpose of the Official Accounts, or engaging in acts that are prohibited by each social media provider; or
(22) Other acts that violate these Terms or public order and morals or that the company deems inappropriate.

Article 8 (Intellectual Property Rights)

*The copyrights and all other intellectual property rights (including, but not limited to, copyrights, design rights, patent rights, utility model rights, trademark rights and know-how, and including the rights stipulated in Articles 27 and 28 of the Copyright Act; collectively, the “Intellectual Property Rights, Etc.”) in and to the information displayed on the Official Accounts will belong to the company or the right holder, such as the copyright holder.

*With respect to the Intellectual Property Rights, Etc. in and to the information made public on the Official Accounts by Users, the Users will grant to the company the right to use such information anywhere in the world, free of charge, and on a non-exclusive basis, and will not exercise any Intellectual Property Rights, Etc. such as moral rights to such content against the company. Further, Users do not have any right to claim compensation for the grant of such right.

*Users may not, without permission from the right holder, use any information provided via the Official Accounts beyond a scope not subject to restriction by the Copyright Act, such as private reproduction by the individual User as permitted by the Copyright Act. Further, any use for profit-making purposes is prohibited.

*If any problem arises with the right holder or a third party as a result of a breach of the provisions of this Article, the relevant User must resolve the problem at his/her own responsibility and expense and must hold the company harmless from such problem.

Article 9 (Handling of Personal Information)

*The company recognizes the importance of personal information and has established the Privacy policy. Any personal information received from you will be properly managed and used in accordance with the company’s Privacy policy.

Article 10 (Governing Law and Jurisdiction)

These Terms will be governed by and construed and applied in accordance with the laws of Japan. If any problem that cannot be resolved in accordance with these Terms arises in connection with the use of the Official Accounts, the company and the relevant User will discuss the problem in good faith and resolve it. Further, if any problem arises and such problem cannot be resolved even after good faith discussion between the parties, and it becomes necessary to file a lawsuit in connection with the use of the Official Accounts, the Tokyo District Court will have exclusive jurisdiction as the court of first instance.
